TERMS OF SERVICE

Thank you for your interest in using the online services provided by EDmama, Inc. (hereinafter referred to as “EDmama”). These Terms of Service govern your use of online and/or mobile services, websites, and software provided by EDmama, including but not limited to edmama.com and its associated mobile applications (collectively, the “Service”).
By accessing or using the Service, or by clicking a button or checking a box indicating acceptance, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the “Agreement”), including our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
1. USE OF THE SERVICE
The Service is designed to facilitate interactive learning in multiple subjects, including mathematics, language arts, science, and social studies. It is continuously evolving to offer enhanced educational experiences. Any new features or improvements added to the Service shall be subject to this Agreement. The Service is provided “as-is,” and EDmama assumes no liability for errors, omissions, data loss, or interruptions in availability.
EDmama grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service strictly in accordance with these Terms. You may not attempt to reverse-engineer, modify, copy, distribute, or resell the Service or its components. Unauthorized access or use beyond the explicitly granted scope is strictly prohibited and may result in legal consequences.
2. ELIGIBILITY
The Service is not intended for children under the age of 18 without parental or school authorization. By using the Service, you affirm that you are either:
(i) at least 18 years old, or
(ii) using the Service with parental or school consent and supervision.
If you are an authorized representative of a school, you acknowledge and agree that it is your responsibility to obtain all necessary parental consents for students under the age of 13 using the Service, in compliance with applicable laws such as the Children’s Online Privacy Protection Act (COPPA).
3. ACCOUNT REGISTRATION & RESPONSIBILITIES
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete registration information and to keep your login credentials secure. You are solely responsible for activities conducted under your account. EDmama reserves the right to suspend or terminate accounts that provide false, misleading, or outdated information.
Account-sharing is strictly prohibited. If unauthorized use of your account is suspected, you must notify EDmama immediately. EDmama assumes no liability for losses incurred due to unauthorized account access resulting from user negligence.
4. SUBSCRIPTION & BILLING
EDmama offers subscription-based access to the Service. Subscription details, renewal terms, and cancellation policies are clearly disclosed at the time of purchase.
- Automatic Renewals: Subscription plans automatically renew unless canceled before the renewal date.
- Payment Terms: Payments must be completed per the stated terms at the time of purchase. EDmama reserves the right to suspend accounts with overdue payments.
- Refund Policy: Refunds are granted only in accordance with our refund policy. Except as required by law, all fees are non-refundable.
5. STUDENT DATA & PRIVACY
When EDmama contracts with schools, it may collect or process Student Data in compliance with laws such as FERPA and COPPA. Schools are solely responsible for securing parental consent for student participation.
- Data Security: Student Data is stored securely and is accessible only to authorized personnel.
- Data Access: Schools may request access, modification, or deletion of Student Data upon written request.
- Prohibited Use: EDmama does not use Student Data for marketing or advertising purposes.
6. USER CONDUCT
By using the Service, you agree NOT to:
- Violate any applicable laws or regulations.
- Upload, transmit, or distribute viruses, malware, or other harmful software.
- Engage in unauthorized data collection, scraping, or hacking.
- Impersonate others or misrepresent affiliations.
- Use the Service for any unlawful, fraudulent, or harmful purpose.
Any violations may result in immediate account termination and legal action where applicable.
7. INTELLECTUAL PROPERTY
All content, trademarks, and intellectual property associated with the Service are owned by EDmama or its licensors. You are granted no rights to use EDmama’s trademarks, logos, or proprietary materials except as explicitly authorized. Unauthorized reproduction, modification, or distribution of content is strictly prohibited and may lead to legal enforcement.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, EDmama shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service. If liability is determined, EDmama’s total liability shall not exceed the total amount you paid for the Service in the preceding 12 months.
This limitation applies even if EDmama has been advised of the possibility of such damages.
9. TERMINATION
EDmama reserves the right to terminate your account or restrict access at any time for violations of these Terms. Upon termination, your access to the Service will be revoked, and any associated data may be deleted without liability to EDmama.
10. DISPUTE RESOLUTION & GOVERNING LAW
Any disputes shall be resolved through binding arbitration under the laws of Hong Kong, China. By using the Service, you waive the right to participate in class-action lawsuits. Arbitration shall be conducted in Hong Kong under the rules of the Hong Kong International Arbitration Centre (HKIAC).
11. MODIFICATIONS TO THESE TERMS
EDmama reserves the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If material changes occur, notice will be provided via email or through the Service.
